1. Agreement

By accessing or using the NeverColdCall website ("Site") and services, you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.

2. Services

NeverColdCall provides lead generation services for property investment professionals in Australia. We deliver qualified leads and/or booked appointments on a pay-per-lead basis. Leads are paid for upfront on a weekly basis.

3. Eligibility

Our services are intended for licensed professionals operating in the Australian property investment industry. By applying, you represent that you are authorised to conduct business in your stated capacity.

4. Application Process

Submitting an application does not guarantee acceptance. We review all applications and reserve the right to decline service at our discretion. Phone verification via SMS is required to complete your application.

5. Payment

• Leads are charged on a per-lead basis
• Payment is required upfront on a weekly basis
• There are no setup fees, contracts, or lock-in periods
• Pricing is agreed upon before service begins
• All prices are in Australian Dollars (AUD) unless otherwise stated

6. Lead Quality

We make reasonable efforts to deliver leads that meet your stated qualification criteria. However, we do not guarantee that every lead will convert to a sale. Lead quality is based on the qualification requirements you provide during onboarding.

7. Exclusivity

Leads delivered to you are exclusive. We do not sell the same lead to multiple clients.

8. Intellectual Property

All content on this Site, including text, graphics, logos, and software, is the property of NeverColdCall and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

9. Limitation of Liability

To the maximum extent permitted by Australian law, NeverColdCall shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability is limited to the amount you paid for services in the preceding 30 days.

10. Termination

Either party may terminate the service relationship at any time. There are no cancellation fees. Unused prepaid credits are non-refundable unless otherwise agreed in writing.

11. Governing Law

These terms are governed by the laws of Australia. Any disputes will be resolved in the courts of Australia.

12. Changes

We may update these terms from time to time. Continued use of the Site after changes constitutes acceptance of the revised terms.
